PRIVACY POLICY

We require certain information regarding our guests in order to process the booking and make arrangements for their stay.  These details include full names, address, email address, and telephone numbers. We will not pass on any details to any other parties other than those operators or companies directly involved with your booking, unless required to do so by a law official or a court of law.


RETURN AND CANCELLATION POLICY

A 40% non-refundable deposit of the rental is required to confirm the booking, with the balance due 8 weeks prior to arrival. The balance is refundable up to 4 weeks prior to arrival. The deposit and balance is not refundable less than 4 weeks prior to arrival. The damage deposit must be paid along with the rental, and is returned (less damages and international phone calls) not more than 21 days after departure.


BOOKING TERMS AND CONDITIONS

The Contact shall be between the SEG and the GUEST on the basis of these Conditions. By making a booking the GUEST confirms that all persons named in the booking have agreed to be bound by these Conditions and all other terms of the contract.

These Terms and Conditions shall be governed by and construed in accordance with Trinidad and Tobago law and you the GUEST. SEG irrevocably agree that the Trinidad and Tobago courts are to have exclusive jurisdiction to settle any disputes which may arise out of or in connection with these Terms and Conditions.

SEG reserves the right to modify or replace these Terms of Service at any time. Any change shall be effective immediately as it appears on the site.

GUESTS are expected at all times throughout their holiday to conduct themselves in a proper manner and with respect to the health and safety of all others.

No reservation is confirmed until a deposit of 40% of the full rental has been received by SEG.  A confirmation email and letter will be sent confirming receipt of payment and further rental information. 

When an enquiry is made regarding the rental of the villa, if firm dates are given, the owners will hold the villa for a period agreed with the GUESTS before being made available to other guests.  The owners will require the deposit to be paid as soon as it is reasonable to secure the booking.  We ask all GUESTS not to book flights before they confirm their rental with us.

We cannot accept bookings from any person aged 18 years or younger.  All GUESTS aged 18 or younger must be accompanied by an adult aged 21 years or over who will be at all times responsible for their behaviour and safety.

In the event that a ‘force majeure’ (fire, earthquake, hurricane, flood, political revolution or other circumstance outside all party’s control) prevents the client from normal use of the rental property, all funds received by SEG shall be refunded to the client.

Neither party shall be liable to the other if prevented by a ‘force majeure’ from fulfilling its obligations. In the event that a ‘force majeure’ causes the client to be vacated from the property during stay, the unused portion of the vacation, on a pro-rata basis, will be refunded to the company by the member.

If for any reason whatsoever, we have to cancel your booking at Ohana Villa, we will refund all monies paid or find suitable alternative accommodation with full transfer of any money paid to the new owner/company of the alternative accommodation.  Should such a situation occur, the SEG will notify the guest as soon as possible. 
           
Should SEG not be able to find suitable alternative accommodation within a reasonable amount of time, they reserve the right to refund any money paid, so ending the Contract between the GUESTS and themselves.  SEG cannot be held liable for any other services that may have been booked.

If you wish to increase or reduce the number of people in your party, or make a name change or make any other amendments to your booking, a fee of US $50 per alteration will be charged to cover costs incurred by us together with any costs incurred or imposed by SEG. Date changes cannot be made to bookings within two months of the arrival time.

We reserve the right to amend the prices shown on the website at any time.

The Guests will report any damage they have caused to the villa or its contents immediately to the Ohana Villa House Manager. The GUESTS accept full liability for any damage they have caused to the villa or its contents and will make immediate arrangements to pay for said damage.  The GUESTS accept that the damage deposit does not limit our liability for any damage they have caused.

When a wire transfer is made to send funds, the cost of immediate transfer will not be deducted from SEG funds.

Refundable monies are held by SEG for up to 21 days after a client’s departure from the property.

GUESTS will settle all outstanding expenses directly with the Ohana Villa House Manager, or SEG before their departure from Ohana Villa.


CHECK IN / CHECK OUT

The GUESTS agrees that Check-in time is 2.00 pm & that check-out time is 11:00am.  An earlier check-in or a later check-out may be possible; however this will be totally dependent on new guests’ arrival time.  The GUESTS accept that a change to the check-in or check-out times may not be possible.


OCCUPANCY

Ohana Villa can accommodate a maximum of eight guests (twelve if fold out beds are provided for children). The lead person (i.e. the person who made the reservation) shall be held responsible for all occupants whilst renting the villa.  SEG asks that all guests do not play loud music at anytime or cause a nuisance to others.

The GUESTS accept that if they are found participating in any illegal activity or found in possession of any illegal substance in the villa, they will be reported to the authorities and required to leave the premises immediately with no refund of the rental due.

The GUESTS understand that they must refrain from acts which may be considered a nuisance to guests in neighbouring villas or properties. If the GUESTS are found to be causing excessive disturbance to guests in neighbouring villas or properties, they may be required to vacate the villa immediately with a partial refund of rental due. Absolutely no house parties or functions are allowed without advance written permission from SEG.

Any expenses caused by such an episode will be payable by the lead person named in the booking.

The GUESTS must leave the premises at the agreed time in the confirmed booking.  Should it be necessary to vacate the premises later than agreed the full daily rental will be charged and be payable before departure in local currency.

Should SEG find that the number of people staying at the property exceeds that on the booking form, SEG may, at the absolute discretion of Ohana villa, ask the extra person or persons to vacate the property forthwith. No camping is permitted in the property grounds.


PRICE INCLUDES

Transfer from the airport or harbour to the villa on the day of arrival.
A welcome drink on arrival
Maid service 6 days per week (half day) 
The maid service will include the emptying of all rubbish bins, making of beds, changing of bed linen twice a week.
All local telephone calls.
Help and advice from our House Manager
Water, Electricity and Gas
Transfer to the airport or harbour on the day of departure
Cooking of breakfast (not including ingredients)

Any breakages (these must be paid for in full before the day of departure in US Dollars or TT Dollars)

We have a cooking fee of US $5 per person with a minimum fee of US $20 for 1-4 guests.
We ask that you settle your food and cooking fee before you leave Ohana. You can also get us to shop for you for US $20.
Any miscellaneous charges not mentioned above


LIABILITY

The GUESTS accept liability for any bills left unpaid by us on departure. The GUESTS agree to have any outstanding amounts deducted from the damage deposit by SEG before the balance is refunded. This will be done within 21 days of our departure from the villa.

We accept that SEG is an agent for accommodation at this villa and assumes no liability for property loss or damages, nor liability for injury, accidents or delays.  Transportation (airlines, ferry, charter vessels, rental cars, tours and taxis, etc.) is supplied by providers independently of SEG assumes no responsibility for any loss, injury or damage to person or property because of the acts of the providers. 

Furthermore, as GUESTS we acknowledge responsibility for the villa during occupancy and will observe all security precautions.  GUESTS are advised to take out all relevant insurance usually covered by a travel policy.

It is a condition of the booking that the entire party is covered by comprehensive travel insurance (including cancellation, flight delays, loss and damage to baggage and other property) and health insurance (including evacuation and repatriation coverage). SEG is held harmless by you and your party against all claims including any accidents related to the use of the Villa facilities or locally procured third party services such as, but not limited to, watercraft, water sports, jeep or motorbike rental.

SEG villa shall not be responsible for any delay, additional expense or inconvenience caused directly or indirectly by events outside SEG control such as civil disturbances, fires, floods, severe weather, Acts of God, acts of Government etc.
           
By acceptance of this contract it is assumed by SEG that this requirement has and will be complied with in full.

We accept that the staff of the villa are not responsible for the supervision or care-taking of any children staying at the villa.


COMPLAINTS

SEG does not accept responsibility for the breakdown of the supply of water, or electricity, or of swimming pool filtration systems, though we will use our best endeavors to arrange for any such problems to be solved quickly. If there are any problems during the rental period, which could not be solved by dealing directly with the Villa Manager please contact SEG immediately and we will use our best endeavours to rectify the situation.

It is understood that infrastructure, local standards and conditions are often of a less developed nature in Tobago than in most urban environments. SEG will do as much as can be reasonably expected to avoid and rectify any problems that may occur, but cannot be held responsible for any problems.

Any complaints must be notified to the Ohana villa manager within 24 hours of the occurrence-giving rise to the complaint. Should a problem remain unsolved please make a complaint in writing to SEG within 14 days of the completion of the rental period. If the Villa is vacated before the end of the rental period without mutual agreement, this may result in the loss of all rights to compensation.


POOL

There is no lifeguard on duty at the villa. The GUESTS accept that the use of the swimming pools, spa and beach is at the GUESTS own risk and that there is no liability on the part of SEG for any injury that may result.

We do not recommend that children are allowed in the pool or it's surrounding area without adult supervision. No diving, running or jumping.  Swimming aids such as floatation devices are to be used at your own risk. If you decide to rent the villa with small children, you may do so, entirely at your sole risk.


GUEST BEHAVIOUR

No guests apart from those named above shall reside at the villa during our stay, unless authorised by SEG. All other guests who may use the Ohana Villa facilities will need authorisation from the Ohana Villa House Manager.  The GUESTS accept that if unauthorised guests are found either residing at the villa or using the facilities, they may be required to vacate the villa immediately with no refund of the rental due.


SMOKING

Smoking is permitted in the main living areas of the villa.  It is strictly forbidden to smoke in any of the bedrooms.


PETS

Pets, guide dogs or hearing dogs can stay at the discretion of the SEG and permission must be granted before the Guests arrrival. 


LOSS OF ENJOYMENT

We cannot be held responsible for any 'loss of enjoyment' due to matters beyond our control such as loss of television reception, weather, ill health, failure of other operators etc.
